The Supreme Court recently stated that there is no fundamental right to claim reservation, as Articles 16(4) and 16(4-A) of the Constitution are enabling provisions rather than mandates. While Article 16(4) allows the State to provide reservations in favor of any backward class for appointments, and Article 16(4-A) permits reservation in promotions, these articles do not require the State or its agencies to offer reservations in every selection process. However, the State's decision not to implement reservations must be backed by quantifiable data and valid reasoning.
