World Intellectual Property Organization (WIPO) Highlights Surge in Intellectual Property (IP) Filings in India
WIPO has noted a significant increase in intellectual property (IP) filings in India. Over the past decade, India's patent applications have more than doubled, trademark filings have increased 2.5 times, and design filings have grown over threefold.
Types of Intellectual Property Rights (IPR):
- Patent: An exclusive right granted for an invention for a limited period, typically 20 years.
- Trademark: A sign that distinguishes goods or services of one enterprise from those of others.
- Industrial Design: The aesthetic or ornamental aspect of a product.
- Geographical Indication: A sign used on products that have qualities or a reputation due to their specific geographical origin.
- Copyright: Rights granted to creators of literary, artistic, and scientific works.
Global Treaties & Protocols for IPR Filing:
- Patent Cooperation Treaty (PCT), 1970: An international treaty under WIPO with 158 contracting states, including India. It allows for patent protection in multiple member countries by filing a single international patent application.
- Madrid Protocol for Trademark Registration, 1989: Establishes the Madrid System, administered by WIPO, for registering and managing trademarks globally. With 115 members, covering 131 countries, including India.
- Hague Agreement Concerning the International Registration of Industrial Designs, 1925: This agreement establishes the Hague System, enabling the protection of industrial designs across multiple countries or regions. India is not a member.
