 Immigration and Foreigners Bill, 2025 Introduced in Lok Sabha

The Immigration and Foreigners Bill, 2025, has been introduced in the Lok Sabha with the aim of streamlining services related to immigration and foreign nationals, including their entry, stay, and exit from the country. This bill seeks to replace four existing laws: the Foreigners Act, 1946; the Passport (Entry into India) Act, 1920; the Registration of Foreigners Act, 1939; and the Immigration (Carriers’ Liability) Act, 2000. These laws, three of which date back to the pre-Constitution era during World War I and II, currently govern immigration and foreigner-related services.

Key Provisions of the Bill:

  • Grounds for Denying Entry or Stay: Foreigners can be refused entry if they are considered a threat to national security, sovereignty, public health, or foreign relations. Decisions made by immigration officers will be final and binding.
  • Tracking Foreign Nationals: Institutions such as educational establishments, hospitals, and nursing homes will be required to report foreign nationals to immigration authorities.
  • Stricter Penalties: Those entering India without valid documents may face penalties, including up to five years of imprisonment or a fine of ₹5 lakh.

Existing Governance Related to Immigration and Foreigners:

  • Registration of Foreigners: Foreign nationals visiting India for more than 180 days must register with the Foreigners Regional Registration Officer.
  • Visa Regulations: The Bureau of Immigration (BoI), established in 1971 under the Ministry of Home Affairs, grants electronic visas to citizens of specific countries.
  • Immigration (Carriers' Liability) Act, 2000: This law holds carriers responsible for passengers who violate the Passport Act.
  • Citizenship Act, 1955: This act regulates the acquisition and registration of foreign nationals as Overseas Citizens of India (OCI).
